Welcome to MortFund Management Services Ltd (“MortFund,” “we,” “us,” or “our”).
These Terms and Conditions (“Terms”) govern your access to and use of our website and services.
By using our services, you agree to be bound by these Terms. If you do not agree, please discontinue use immediately.

1. Definitions

  1. Company / MortFund: MortFund Management Services Ltd, RC 1909233, Suite B2, 87–89 Baale Animashaun Road, Alakuko, Lagos, Nigeria.
  2. Service: The MortFund website and all related services, available at https://mortfund.com.
  3. User / You: Any individual or entity accessing or using the MortFund website or services.
  4. Device: Any device used to access MortFund, including desktops, laptops, tablets, and mobile phones.
  5. Third-Party Social Media Services: External platforms through which users may log in, share, or interact with MortFund.
  6. Affiliate: Any entity controlling, controlled by, or under common control with MortFund (≥50% ownership or voting rights).

2. Acceptance of Terms

  • These Terms apply to all visitors, users, and account holders.
  • Accessing or using MortFund constitutes acceptance of these Terms.
  • Minimum age: Users must be 18 years or older.
  • Use of MortFund is also governed by our Privacy Policy, which explains how we collect, use, and share personal data.

3. User Responsibilities

MortFund is a crowdfunding platform. Users must act lawfully and responsibly while using the service.

Prohibited Activities:

Users must not:

  1. Violate laws or regulations, or infringe on others’ rights.
  2. Submit false, misleading, or fraudulent content.
  3. Offer or promote illegal items or rewards.
  4. Threaten, harass, defame, or abuse other users.
  5. Send spam, chain letters, or unauthorized promotions.
  6. Distribute malware, harmful code, or attempt to disrupt servers.
  7. Misuse other users’ personal data, including for marketing purposes.

Violation of these rules may result in account suspension or legal action.

4. Campaigns, Donations, and Payments

  1. Campaign Commitments:
  • When you pledge to a campaign, your payment details are collected but charged only after the fundraising deadline.
  • MortFund charges a service fee upon successful fund withdrawal.
Payment Processing:
  • Payments are processed via third-party payment partners.
  • Failed or disputed payments may result in pledge cancellations.
Fund Disbursement:
  • There may be a processing delay between campaign success and fund availability.
  • Some pledges may fail to process (expired cards, insufficient funds).
User Data for Campaigns:
  • Fundraisers may request necessary donor information to fulfill campaign obligations.
  • Sensitive information like BVN or NIN must never be requested.
Refunds:
  • Donations to completed campaigns are non-refundable.
  • Duplicate or erroneous charges may be investigated and refunded via the payment processor if verified.

5. Fees and Disputes

  • MortFund deducts platform and payment fees before funds are disbursed.
  • In case of payment-card disputes:
    • We will notify the fundraiser to provide supporting evidence.
    • If the dispute is valid, the fundraiser authorizes us to deduct the disputed amount.

6. Intellectual Property & License

  • All content on MortFund is protected by copyright and trademark laws.
  • Users are granted a limited, non-commercial, non-transferable license to temporarily access and use the website.
  • Users may not:
  1. Copy, modify, or distribute site content
  2. Reverse engineer the platform
  3. Remove copyright or proprietary notices
  4. Mirror content on other servers

Violation may result in license termination and legal action.

7. Disclaimers and Limitation of Liability

  1. As-Is Service:
  • MortFund services are provided “as is” and “as available” without warranties.
  • We do not guarantee uninterrupted access, error-free operation, or virus-free servers.
Liability Limitation:
  • MortFund and its affiliates shall not be liable for indirect, incidental, or consequential damages, including loss of profits, data, or business opportunities.
  • Some jurisdictions do not allow such exclusions; in that case, liability is limited to the maximum extent permitted by law.

8. External Links

  • MortFund may contain links to third-party websites or services.
  • We are not responsible for their content, policies, or practices.
  • Users are advised to review the third-party Terms and Privacy Policies before engagement.

9. Termination

  • MortFund may suspend or terminate accounts immediately for any violation of these Terms or unlawful activity.
  • Upon termination, all access to the Service ends immediately.

10. Governing Law and Dispute Resolution

  • These Terms are governed by Nigerian law.
  • Users agree to attempt informal resolution by contacting info@mortfund.com before formal proceedings.

11. Severability and Waiver

  • If any provision is found unenforceable, the remainder of the Terms remains in effect.
  • Failure to enforce any provision does not constitute a waiver of our rights.

12. Updates to Terms

  • MortFund may modify or replace these Terms at any time.
  • Material changes will be notified 30 days in advance where feasible.
  • Continued use after updates constitutes acceptance of revised Terms.
